These Terms and Conditions govern access to and use of CoolCarGuy.com, TheCoolCarGuy.com, CoolCarGuys.com, and related Cool Car Guy pages, forms, accounts, features, and services that link to these Terms.
CoolCarGuy.com is owned and operated by Cool Car Guy, Inc. Cool Car Guy, Inc. may be referred to as Cool Car Guy, we, us, or our.
CoolCarGuy.com is not a Freak Site and is not owned or operated by Freak Sites, Inc. Cool Car Guy, Inc. and Freak Sites, Inc. are separate companies. They may use similar software, pricing, Parking Spot terminology, Channel-building methods, or affiliate structures, but that similarity does not combine the companies, websites, accounts, obligations, liabilities, or programs.
By accessing the website, creating an account, purchasing advertising, submitting content, joining the Affiliate Program, or otherwise using CoolCarGuy.com, you agree to these Terms and the policies incorporated into them.
If you do not agree, do not use CoolCarGuy.com.
1. WHAT COOLCARGUY.COM IS
CoolCarGuy.com is an independent automotive advertising and publishing website focused on cool cars and subjects genuinely connected to cool-car culture.
The primary advertising product is a full-page advertisement called a Parking Spot. A Parking Spot may be used to sell, promote, showcase, explain, document, or tell the story of a vehicle, business, product, service, event, project, collection, creator, or other permitted automotive subject.
One Parking Spot may stand alone. Multiple Parking Spots connected to the same profile, business, collection, or subject may form a Garage or Channel.
Cool Car Guy may also publish editorial content and offer optional promotional or automotive services under separate terms or agreements.
CoolCarGuy.com provides the advertising page and the website where it appears. The advertiser supplies the subject, claims, content, price, and offer.
2. ADVERTISING SERVICE—NOT AUTOMATIC REPRESENTATION
Unless Cool Car Guy, Inc. expressly enters into a separate written agreement for a specific brokerage, consulting, locating, inspection, marketing, or other automotive service, publishing a Parking Spot does not make Cool Car Guy the advertiser’s dealer, broker, agent, representative, inspector, appraiser, lender, insurer, escrow provider, transporter, buyer, or seller.
Cool Car Guy may separately provide automotive services or participate in a transaction when expressly agreed in writing. Those separate services are governed by the applicable agreement and are not created merely because a Parking Spot appears on the website.
Except for a separately agreed Cool Car Guy service, transactions resulting from user advertisements are between the advertiser and the responding party.
3. ELIGIBILITY AND ACCOUNTS
You must be legally capable of entering a binding agreement to purchase services, create an account, or join the Affiliate Program.
If you use CoolCarGuy.com for a company, dealership, organization, or other entity, you represent that you have authority to act for that entity and bind it to these Terms.
You agree to:
- Provide accurate, current, and complete account information
- Maintain an email address where Cool Car Guy can contact you
- Protect your username, password, devices, and account
- Accept responsibility for activity conducted through your account
- Promptly report suspected unauthorized access
You may not:
- Create an account with false information
- Impersonate another person, company, dealer, or organization
- Use another person’s account without permission
- Transfer or sell an account without written permission
- Create accounts to evade a restriction, suspension, or termination
Cool Car Guy may request reasonable identity, business, ownership, content-rights, or payment verification for security, fraud prevention, dispute resolution, seller verification, or legal compliance.
4. ACCEPTABLE USE
You agree to use CoolCarGuy.com lawfully, honestly, and responsibly.
You may not use the website to:
- Publish false, deceptive, fraudulent, materially incomplete, or misleading information
- Misrepresent identity, authority, ownership, condition, mileage, history, title status, price, location, availability, or another material fact
- Advertise stolen, unlawful, prohibited, counterfeit, or unlawfully obtained property
- Infringe copyrights, trademarks, privacy, publicity, contractual, or other legal rights
- Harass, threaten, defame, exploit, or unlawfully discriminate against another person
- Distribute malware, malicious code, phishing material, or fraudulent payment requests
- Send unsolicited bulk messages or harvest personal information
- Manipulate view counts, referrals, accounts, reviews, commissions, or website activity
- Circumvent moderation, access controls, security tools, or payment rules
- Use CoolCarGuy.com to facilitate illegal conduct or fraud
The Prohibited Ads Policy contains additional restrictions and is incorporated into these Terms.
5. SCRAPING, AUTOMATION, AND TECHNICAL ABUSE
You may not use bots, crawlers, scripts, scraping software, browser automation, artificial-intelligence agents, data-mining tools, or similar methods to collect content, build a competing database, automate accounts, create artificial traffic, harvest user information, or interfere with CoolCarGuy.com without prior written permission.
This does not prohibit ordinary indexing by recognized search engines acting in accordance with our technical instructions.
You may not probe for vulnerabilities, access non-public systems, bypass rate limits, overload servers, defeat robot-exclusion measures, interfere with networks, or attempt unauthorized access.
6. USER CONTENT AND YOUR RESPONSIBILITY
User Content includes Parking Spots, descriptions, stories, photographs, videos, links, logos, vehicle information, prices, contact details, profiles, comments, messages, and other material you submit.
You retain ownership of original User Content you create.
You represent and warrant that:
- You own the content or have all permissions needed to use and publish it
- The content and all material claims are accurate and lawful
- You have authority to advertise the subject or make the offer described
- Required model, property, trademark, copyright, music, video, and other releases or permissions have been obtained
- The content does not violate another person’s rights or another agreement
You are responsible for your User Content and the consequences of publishing it.
7. LICENSE NEEDED TO OPERATE AND PROMOTE THE WEBSITE
By submitting User Content, you grant Cool Car Guy, Inc. a worldwide, non-exclusive, royalty-free license to host, store, reproduce, resize, crop, compress, format, display, distribute, index, excerpt, share, promote, and technically modify that content as reasonably necessary to:
- Operate CoolCarGuy.com
- Display and maintain your Parking Spot or profile
- Provide purchased services
- Create thumbnails, previews, search results, and social-media shares
- Promote your Parking Spot and CoolCarGuy.com
- Use service providers needed for hosting, delivery, search, security, or promotion
- Comply with law, protect rights, and resolve disputes
This license does not transfer ownership of your original content to Cool Car Guy.
The license generally continues while the content is active. Limited copies may remain afterward in backups, archives, accounting or legal records, cached or indexed copies, dispute files, or promotional materials created while the content was active.
8. CONTENT REVIEW AND MODERATION
Cool Car Guy may, but is not required to, review, verify, approve, reject, edit, restrict, unpublish, archive, suspend, or remove content.
We may act when content appears unlawful, misleading, fraudulent, infringing, unsafe, harmful, irrelevant, miscategorized, technically damaging, inconsistent with the cool-car focus, or otherwise contrary to these Terms or another policy.
Publication does not mean Cool Car Guy verified the advertiser, vehicle, title, condition, mileage, history, price, claims, ownership, authority, legality, or transaction.
To the fullest extent permitted by law, Cool Car Guy is not liable for good-faith moderation decisions.
9. USER TRANSACTIONS AND SAFETY
Users are responsible for independently evaluating advertisers, buyers, sellers, vehicles, businesses, products, services, offers, and transactions.
Cool Car Guy does not guarantee:
- A person’s identity, authority, honesty, or ability to pay
- Vehicle ownership, title status, mileage, history, condition, safety, legality, or availability
- The accuracy of photographs, descriptions, prices, links, or other claims
- Successful negotiation, payment, delivery, transfer, performance, or completion
Users are responsible for their own:
- Inspections, title checks, history reports, appraisals, and due diligence
- Contracts, deposits, payments, financing, taxes, licensing, registration, and insurance
- Shipping, delivery, transportation, storage, and transfer arrangements
- Professional advice and legal compliance
Never send money or disclose sensitive information without independently verifying the other party and the transaction.
10. PARKING SPOTS, PRICING, AND DURATION
The current standard Parking Spot is a one-time $7 advertising purchase. The price and product description displayed at checkout control the purchase.
A standard Parking Spot is not a subscription and does not have a scheduled renewal or scheduled expiration.
No scheduled expiration does not mean guaranteed lifetime hosting, permanent search ranking, permanent technical availability, or immunity from these Terms, moderation, legal requirements, account status, website changes, or discontinuation.
Cool Car Guy may change future pricing, features, photo or video limits, categories, fields, storage, or available products. A future price change does not create an additional charge for a completed one-time purchase unless the customer separately orders something new.
Parking Spot purchases and optional promotional services are also governed by the Advertising Terms, Advertising Refund Policy, checkout disclosures, and product-specific terms.
Purchasing advertising does not guarantee views, indexing, ranking, clicks, inquiries, leads, offers, buyers, customers, sales, commissions, or income.
11. PAYMENTS, REFUNDS, AND CHARGEBACKS
You agree to pay the amount shown at checkout and authorize Cool Car Guy and its payment processor to charge the payment method provided.
You are responsible for accurate billing information, applicable taxes, bank charges, currency conversion, and third-party fees.
Cool Car Guy may correct obvious technical or pricing errors. When a material error occurs, we may cancel the transaction, issue a refund, request the correct payment, or offer another reasonable remedy.
Refund eligibility is governed by the Advertising Refund Policy and applicable law.
Contact Cool Car Guy before initiating a chargeback so a legitimate billing concern can be investigated. A disputed, reversed, fraudulent, or unpaid transaction may result in account restriction, removal of the associated service, or reversal of related affiliate commissions.
12. COOLCARGUY.COM AFFILIATE PROGRAM, COOKIES, AND ORDER ATTRIBUTION
Cool Car Guy, Inc. operates its own Affiliate Program. It is separate from every Affiliate Program operated by Freak Sites, Inc.
An account, affiliate approval, referral link, customer attribution, commission balance, or payout relationship on CoolCarGuy.com does not automatically create or transfer any right, account, or balance on a Freak Site—and the reverse is also true.
CoolCarGuy.com uses ordinary browser cookies and related technologies as part of normal website operation, including login and account functions, security, spam prevention, order processing, WooCommerce order attribution, and affiliate referral tracking.
Affiliate referrals may be tracked through referral links, cookies, customer-account connections, and available transaction records. Cookies may be blocked, deleted, replaced, restricted, or affected by browser settings, device changes, another qualifying referral, or technical limitations.
Blocking or preventing cookies may interfere with login functions, order attribution, embedded content, purchases, affiliate tracking, or the ability to credit a qualifying purchase to an affiliate.
The current CoolCarGuy.com commission structure may distribute up to 55% of a qualifying purchase through one eligible five-tier path:
- 20% direct referral
- 15% Tier One
- 10% Tier Two
- 5% Tier Three
- 5% Tier Four
Commissions arise only from qualifying advertising or promotional purchases properly tracked or attributed under the current Affiliate Terms. An empty, inactive, or ineligible position does not create a commission obligation.
No commission is earned merely because someone clicks a link, creates a free account, applies to the Affiliate Program, or enrolls another affiliate.
Affiliates must promote CoolCarGuy.com truthfully, comply with advertising law, clearly disclose material affiliate relationships, avoid misleading income claims, and follow the Affiliate Terms.
The Affiliate Terms control affiliate tracking, customer attribution, cookie duration, eligibility, commission rates, reversals, minimum payout, payment method, timing, prohibited promotion, suspension, and termination.
Additional information about cookies and related information practices is available in the CoolCarGuy.com Privacy Policy. If you do not agree with these practices, please do not use the website.
13. EARNINGS AND RESULTS
Advertising results and affiliate income are not guaranteed.
Any example involving views, purchases, referrals, tiers, commissions, repeat customers, Channels, revenue, or income is illustrative only and depends on the assumptions stated.
A mathematical possibility is not a statement of typical, average, expected, probable, or guaranteed results.
The Legal & Earnings Disclosure is incorporated into these Terms.
14. THIRD-PARTY LINKS, VIDEOS, AND SERVICES
CoolCarGuy.com may contain links, videos, maps, payment tools, affiliate offers, social-media content, widgets, or other services operated by third parties.
A link or embed does not mean Cool Car Guy owns, controls, verifies, endorses, sponsors, or guarantees the third party.
Third-party content may stop working or change without notice. Your interaction with a third party is governed by that party’s terms, privacy practices, availability, and transaction rules.
15. INTELLECTUAL PROPERTY AND COPYRIGHT CONCERNS
CoolCarGuy.com, its design, branding, logos, original text, graphics, software configuration, features, and other company materials are owned by or licensed to Cool Car Guy, Inc.
You may not copy, frame, mirror, republish, resell, impersonate, reverse engineer, or use Cool Car Guy intellectual property in a way that creates confusion, suggests unauthorized endorsement, or violates law.
Limited factual reference and authorized sharing of public links are permitted when lawful and not misleading.
Copyright and other content-rights concerns should be submitted through the Copyright Complaints procedure.
16. PRIVACY
The Privacy Policy explains how Cool Car Guy collects, uses, stores, and discloses information.
You may not scrape, collect, sell, disclose, or misuse another user’s personal information without lawful authority.
17. SERVICE AVAILABILITY, CHANGES, AND TERMINATION
Cool Car Guy may change, add, remove, replace, suspend, or discontinue features, categories, URLs, fields, integrations, account tools, affiliate tools, or other parts of the website.
We do not guarantee uninterrupted operation, permanent URLs, error-free service, continued availability of every feature, or that data will never be lost.
Cool Car Guy may restrict, suspend, or terminate accounts, content, advertising, affiliate participation, purchasing privileges, or website access when reasonably necessary to enforce these Terms, prevent harm or fraud, address payment disputes, comply with law, protect the website, or discontinue a service.
Termination does not automatically create a refund. Provisions concerning payments, content licenses, intellectual property, disclaimers, liability, indemnification, and disputes survive when reasonably necessary.
18. ELECTRONIC COMMUNICATIONS
You consent to receive account, purchase, affiliate, security, service, policy, and legal communications electronically through email, account notices, or website notices.
You are responsible for maintaining a current email address. Optional marketing emails may be unsubscribed from, but necessary transactional, account, security, and legal communications may still be sent.
19. DISCLAIMERS
TO THE FULLEST EXTENT PERMITTED BY LAW, COOLCARGUY.COM AND ITS SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
Cool Car Guy disclaims express and implied warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, reliability, security, uninterrupted operation, visibility, traffic, results, and profitability.
Cool Car Guy does not warrant that content is accurate, users are trustworthy, vehicles are as described, transactions will be completed, advertisements will receive attention, data will never be lost, or third-party services will remain available.
Some jurisdictions do not allow certain exclusions, so some of these provisions may not apply to you.
20. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Cool Car Guy, Inc. and its officers, directors, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, revenue, sales, commissions, opportunities, data, reputation, or goodwill; or business interruption arising from CoolCarGuy.com, User Content, advertisements, transactions, third-party conduct, account restrictions, content removal, data loss, or inability to use the website.
To the fullest extent permitted by law, Cool Car Guy’s aggregate liability for a claim will not exceed the greater of the amount paid for the specific product or service giving rise to the claim or the total amount paid to Cool Car Guy during the 12 months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
21. INDEMNIFICATION
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Cool Car Guy, Inc. and its officers, directors, employees, contractors, licensors, and service providers from claims, losses, liabilities, judgments, penalties, costs, and reasonable legal fees arising from your use of CoolCarGuy.com, User Content, advertisement, product, service, transaction, violation of law, infringement of rights, breach of these Terms, or misleading or unlawful conduct.
Cool Car Guy may control the defense of a covered claim, and you agree to reasonably cooperate.
22. U.S. MARKET AND SERVICE AREA
CoolCarGuy.com is operated from the United States, and its website, advertising products, Affiliate Program, automotive content, and other commercial services are intended for users and customers in the United States.
Cool Car Guy does not intentionally market its commercial services to residents of foreign jurisdictions.
CoolCarGuy.com may be publicly accessible through the Internet from locations outside the United States. Public accessibility does not mean that Cool Car Guy intentionally offers its commercial services in every jurisdiction from which the website can be viewed.
If you are located in a jurisdiction whose requirements are incompatible with the normal operation of CoolCarGuy.com, please do not create an account, purchase a product, participate in the Affiliate Program, submit content, or otherwise use the commercial services.
Users remain responsible for complying with laws that apply to them, their content, and their transactions.
23. GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of the State of New Mexico, without regard to conflict-of-law principles.
Unless applicable law requires otherwise, legal proceedings arising from these Terms or CoolCarGuy.com will be brought in a court of competent jurisdiction serving Doña Ana County, New Mexico.
The parties agree to attempt in good faith to resolve disputes informally before filing litigation.
Nothing prevents an eligible small-claims matter, emergency injunctive relief, a report to a government agency, or the exercise of a right that cannot lawfully be waived.
24. CHANGES AND INCORPORATED POLICIES
Cool Car Guy may update these Terms. The revised version will be posted with a new effective date and generally applies prospectively.
The version in effect when a purchase is completed governs that purchase together with product-specific terms and later changes lawfully applicable to continued website use or hosting.

25. GENERAL LEGAL TERMS
You may not assign your rights or obligations under these Terms without written permission. Cool Car Guy may assign these Terms in connection with a merger, acquisition, sale, reorganization, transfer of assets, website transfer, or operation by a successor.
If any provision is unenforceable, it will be enforced to the maximum extent permitted or modified as necessary, and the remaining provisions continue.
Failure to enforce a provision is not a waiver. A waiver must be in writing by an authorized representative.
These Terms do not create third-party beneficiary rights.
These Terms and incorporated policies are the entire agreement concerning general use of CoolCarGuy.com, except for a separate written agreement signed by an authorized representative of Cool Car Guy, Inc.

- Do your own due diligence before sending money or completing a transaction.
- Do not scrape, spam, manipulate, defraud, or misuse personal information.
- Affiliate commissions come only from qualifying purchases properly tracked or attributed under the Affiliate Terms.
- Cool Car Guy may moderate content and protect the website.
